
Obama defends Bush-era secrets

“President Obama’s administration is moving aggressively to protect what the government insists are “state secrets” from a Bush-era wiretapping program.Justice Department lawyers filed an emergency motion Friday with a federal appeals court in an effort to block a lower court’s order that the government must show lawyers for the Al-Haramain Islamic Foundation a copy of a document indicating that the group’s communications were being intercepted. The document has been the subject of a running legal battle since the papers were accidentally sent to attorneys for the group in 2004 and subsequently retrieved. [Full Story]

The follow up to this, of course, is the the Federal Appeals Court rejects this stance by the Justice Dept. and is allowing the suit by this Muslim organization to move forward. The President…………..Bush, that is……..didn’t have a stellar track record in court on this particular sort of thing. One would hope that the Obama Administration’s stance to date was simply HIS people in the Justice Dept. taking their time to come up to speed on active matters before the Courts. It’s not unusual in a transition period for this to happen.
Having said that, though, Jeff, you’re about to learn about your worse nightmares. Broad powers taken into the Presidency by George W. Bush are now broad powers available to President Obama. The shifting of the balance of powers between the three branches of government that took place under “43″ are now in the hands of “44″. Be careful what you wish for!
Update: The release of those “secret” legal opinions of the Bush Administration by the Obama Attorney General doesn’t bode well for too much continuation of the Bushco disregard for civil liberties.
I particularly liked the ones trampling on the 1st and 4th Ammendments. With legal scholarship like that, can you imagine a Supreme Court with Harriet Myers on it?
